Federal Regulations under 40 Code of Federal Regulations (CFR) Section
144.84 provide the flexibility to allow Class V Aquifer Storage and Recovery (ASR) Projects to operate under conditions Authorized by Rule or Permit. Region 8 has taken advantage of this flexibility by defining and allowing relatively low risk type ASR projects to operate under conditions Authorized by Rule. While projects which pose a potential risk to underground sources of drinking water (USDWs) operate under conditions set in a Permit. The region continues to evaluate the use of these authorization mechanisms as part of its implementation policy.
