Anatomy of a Groundwater War: Mississippi v. Tennessee

Mississippi filed suit against Tennessee for alleging appropriating water beneath the state that belongs to Mississippi. This case represents the first interstate water war over groundwater. The case has followed a long and winding path to the United States Supreme Court and the issues presented are unique and complex. Numerous legal briefs have been filed. The Special Master has filed a Memorandum of Decision on significant preliminary issues and further proceedings have been scheduled, targeting a late 2017 or early 2018 hearing that may end the matter. This session will describe the issues in the case and explain the relevance of the eventual findings to the water industry.
